General Terms and Conditions of the Namaste Kids Help Shop

§1 Scope with regard to businesses and definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code, BGB).

§2 Conclusion of a contract, storage of the contract text

(3) The presentation of the goods in our online shop does not constitute a legally binding offer on our part, but merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

Before bindingly submitting the order, the consumer can, after checking their details, use the “Back” button of the internet browser they are using to return to the page on which the customer’s details are recorded and correct input errors, or cancel the ordering process by closing the internet browser. We confirm receipt of the order immediately by an automatically generated e-mail (“order confirmation”). With this, we accept your offer.

(5) Storage of the contract text for orders via our online shop: We store the contract text and send you the order data and our General Terms and Conditions by e-mail. You can view your past orders in our customer area under My account → My orders.

§3 Prices, shipping costs, payment, due date

(1) The prices stated include statutory VAT and other price components. Standard shipping is free of charge. For express shipping within Germany we charge a surcharge of €29.90, which is shown before the order is completed.

(2) The consumer can pay by payment in advance, direct debit, PayPal or credit card (Visa, Mastercard).

(3) If the consumer has chosen payment in advance, they undertake to pay the purchase price immediately after conclusion of the contract.

§4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for immediate dispatch. In this case, delivery takes place within 3 working days at the latest. For payment in advance, the delivery period begins on the day after the payment order is given to the bank instructed with the transfer; for all other methods of payment, it begins on the day after conclusion of the contract. If the end of the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the goods sold passes to the buyer only upon handover of the goods to the buyer, including in the case of sale by dispatch.

§5 Retention of title

We retain title to the goods until the purchase price has been paid in full.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquired physical possession of the goods.

To exercise your right of withdrawal, you must inform us

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but this is not mandatory.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.

We will bear the cost of returning the goods.

§6a Voluntary right of return of thirty days, free returns and exchange

The following provisions apply in addition to the statutory right of withdrawal described in §6. They extend your rights and do not restrict the statutory right of withdrawal in any way.

(1) In addition to the statutory right of withdrawal under §6, we grant consumers a contractual right of return of thirty days from receipt of the goods. The statutory right of withdrawal under §6 remains unaffected and exists independently of this contractual right of return.

(2) The contractual right of return is exercised by sending the goods back within the period. Sending them in good time is sufficient to meet the deadline.

(3) The contractual right of return applies to goods that are complete, unused and unworn. For goods that do not meet these conditions, the statutory right of withdrawal under §6 remains in full force.

(4) We bear the cost of returns, for returns from Germany as well as from all other countries. This applies to withdrawal under §6, to the exercise of the contractual right of return and to exchanges under this section. For orders within Germany, a return label is enclosed with the parcel.

(5) Instead of a return, we will exchange unworn, unused new goods for another item within the same period of thirty days. Price differences will be refunded or charged.

(6) For goods made to the customer’s specifications or tailored to personal needs, there is no contractual right of return and no exchange under this section. Any statutory right of withdrawal remains unaffected.
